Boat Parking Rules & Regulations
----------------

General Conditions

1. Anyone who wishes to apply for boat parking must be a fully paid up member of Pembrokeshire Yacht Club.

2. Every applicant must apply for a boat parking space on an annual basis. The committee has the right to refuse any application.

3. No member or non-member has the right to park a boat in the compound of Pembrokeshire Yacht club without signing the declaration on an annual basis.

4. Boat Parking subs are valid from 1st October until 30th September of the following year.
All invoices will be posted prior to October 1st. Early payment will secure maximum vouchers (see conditions of redeemable vouchers below). If payment has not been received by December 31st 2009 your boat may be removed from the compound.

5. Commercial Rates – Pembrokeshire Yacht Club is a recreational club and will give priority to members whose boats are for recreation only. The use of any boat on a commercial basis must be declared. Where the committee determine that a boat in the compound is being used on a commercial basis they will seek a meeting with the owner to negotiate higher fees.

Boat Parking Charges

6. To encourage members use the Club-house & Bar and pay promptly, £50 of the boat parking charge is redeemable in the form of 20 x £2.50 vouchers (see conditions of redeemable vouchers below).

7. As of October 2009, the annual charge for all sailing dinghies and yacht tenders in the compound is £130.00, which will include the redeemable vouchers.

8. As of October 2009 all other boats stored in the compound will be charged at the rate of £4.52 per foot per annum, plus a £117 surcharge. With the exception of sailing dinghies and yacht tenders all other boats up to 18 feet in length will be charged at £199 per annum. All boats over 18 feet will be charged at £199 plus £4.52 for each and every foot in length over 18 feet. These charges will include the redeemable vouchers.

9. In the event of having more than one boat / trailer in the compound, i.e. a large boat and a tender. As long as the tender is within the plot the main trailer is occupying, there will not be a double charge. As long as there is no risk to the membership from falling equipment, then a tender can sit in or on top of the main boat, or two or more boats on a stacking system for example is acceptable. You are paying for the space taken rather than the boat(s). However, all boats and tenders must be declared and identified.

10. Monthly or seasonal rates will be at the discretion of the Boat parking secretary.

Conditions of boat parking

11. In the interest of the club, the Committee reserves the right to move any boat around the compound at any time, without notice to the owner. Although every attempt will be made to notify the owner should it be necessary.

12. Where an owner’s insurance policy states that the boat must be clamped or locked, it is the owner’s responsibility to ensure that a key is made available to the Boat Parking Secretary.

13. On signing the declaration, if the owner fails to comply with Rule No. 12 and the committee needs to move any boat, the committee will exercise its right to remove the security device by whatever means necessary.

14. All boats must have adequate third party liability insurance to a minimum value of £1 million.

15. On successful application of boat parking you will be given a boat parking identity number. In order that the Boat Parking Secretary, Committee and other members can identify you, the forward area of your trailer will be painted yellow and your boat parking identity number will be written on this painted area.

16. On successful application of boat parking, you will be allocated a permanent parking slot, you must park your boat/trailer in the said place. If you have not been allocated a space, you may park you boat in any unmarked boat parking area as directed by the boat parking secretary. However, every attempt must be made to park in the space allocated every time.

17. Failure to re-apply or pay for boat parking annual subs gives the committee the right to remove the boat in question without reason. Your declaration from the previous year gives the committee the right to remove the boat/trailer from the compound after September 30th of the following said year.

18. On the grounds of Health & Safety it is a requirement that all boats and especially trailers are in a ‘Safe condition’. It is owner’s responsibility to ensure that their boat or trailer is in a safe condition. However, the committee may make the decision that a boat or trailer is unsafe, on which the owner is required to act immediately.
Safe condition of trailers - as long as the trailer is not a hazard to the membership and can be safely moved around the compound with its load on. It does not mean road-worthy.
Safe condition of boats - as long as the boat is not a hazard to the membership.

19. If any of the Rules listed from 1 – 16 are not adhered to, a person may be seen as acting in a way that is seen to be detrimental to the club. The committee may at any time terminate both membership and boat parking facilities from them, without refund.
An owner will be given one week’s notice in writing via recorded delivery. After this notice has expired, the committee will remove the said boat/trailer from the compound and inform the necessary authorities as to the boats whereabouts, upon which legal action may then be taken against the owner.

Conditions of Redeemable vouchers

20. The redeemable vouchers are non-transferable between members and can only be used to purchase alcohol, soft drinks and sundries. They cannot be used to purchase tobacco products.

21. The full £50 entitlement of vouchers will only be issued if payment is received on or before October 31st 2009.
If payment is received between November 1st 2009 and November 15th 2009, your voucher entitlement will be £30. If payment is received between November 16th and November 30th 2009, your voucher entitlement will be £10.
If payment has not been received by December 31st 2009 you will have no entitlement to vouchers and your boat will be removed from the compound.

22. Vouchers can only be used up until 31st May of the current year, unless authorised by the Boat Parking Secretary.

23. No change will be given if the total expenditure does not match the amount of the voucher(s) used. (i.e. if total purchase is £3.55 and two vouchers are used, no change will be given.)

24. Cash can be added to the voucher(s) to meet total expenditure.
